Is a fire risk assessment a legal requirement in Nottingham? +

Who is the responsible person for fire safety at my premises? +
Under the Fire Safety Order, the responsible person is the employer in relation to work premises, or the person who has control of the premises in any other case. In practice this is usually the business owner, landlord, managing agent, or facilities manager. Where a building has multiple occupiers, there may be more than one responsible person, and they are expected to coordinate their fire safety arrangements. The responsible person may appoint a qualified fire risk assessor to carry out the assessment, but the legal responsibility for compliance remains with them personally.
Do I need a professional assessor or can I do it myself? +
The Regulatory Reform (Fire Safety) Order does not make it legally mandatory to use an external assessor — it requires only that the assessment is suitable and sufficient and that the person carrying it out is competent. For anything beyond the simplest, lowest-risk single-room premises, using a qualified professional is strongly recommended. An inadequate self-assessment can leave you personally exposed in the event of a fire, and Nottinghamshire Fire and Rescue Service may not accept it as evidence of compliance. What can Nottinghamshire Fire and Rescue Service do if I don’t have one? +
Nottinghamshire Fire and Rescue Service can inspect your premises without warning at any time. Where they find no fire risk assessment, or one that is not suitable and sufficient, they can issue an enforcement notice requiring corrective action by a set deadline, issue a prohibition notice closing your premises immediately where there is a serious risk to life, or bring a criminal prosecution against the responsible person. Unlimited fines and custodial sentences of up to two years are available to the courts. Building insurance can also be invalidated where no compliant assessment is in place.
How long will my assessment take? +
On-site time varies with the size and nature of the premises. A small office or retail unit typically requires one to two hours. An HMO or medium-sized commercial premises will usually take two to four hours. Care homes, schools, large warehouses, and complex multi-occupancy buildings may require a full day or more.
